Terms and Conditions of Web Site User Agreement

PLEASE READ THESE TERMS & CONDITIONS OF WEB SITE USE CAREFULLY.

The following Internet Web Site Agreement (the “Agreement”) is between you, the end-user (“user” or collectively “users”), and Epic Events. (“The Buffalo Run”) and any subsidiaries, properties, or affiliates of Epic Events. All references to the company also collectively include all owners, officers, directors, employees, partners, and representatives of Epic Events.

The Agreement outlines the terms and conditions under which users agree to use the Buffalo Run Web site (the “site” or the “Web site”). Accessing and/or use of the thebuffalorun.com site implies your full consent to this Agreement.

1. CONSENT TO THIS AGREEMENT

1.1 Consent. You must agree to all of the terms and conditions outlined in this Agreement in order to use the Buffalorun.com site. By using the Buffalorun.com site you confirm that:

1.1.1. You have carefully read this Agreement in whole and acknowledge that you accept all of the terms and conditions within.
1.1.2. You have the full right and capacity to enter into this Agreement with Epic Events and consent to all of the terms and conditions within.

If you do not accept any or all of the terms and conditions of this Agreement you may not use the buffalorun.com site.

1.2 Changes to the Agreement. Epic Events reserves the right to make any changes to the Agreement at any time and in any capacity. If Epic Events decides to change or modify any or all of the terms and conditions in the Agreement, the company will post those changes on the “Terms and Conditions” page of the buffalorun.com site. Your continued use of the buffalorun.com site after any changes to the Agreement have been made and posted will constitute your acceptance of any such changes made.

1.3 Changes to the Site. Epic Events reserves the right to make any changes to the Buffalorun.com Web site, at any time and without notification. This right includes changes, modification, suspension, or complete discontinuance of the site or any of its sections, functions, features, content, services, or database(s) in part or in whole. This also includes Epic Events right to restrict your access to and/or place limits on any or all sections, functions, features, content, or services on or related to the site at any time, without notification, and to do so free from liability.

2. WEB SITE USAGE AND MEMBERSHIP

2.1 Registration Data and Account Security. By accessing and using the site, you agree to provide accurate and current registration data during the registration process and during any subsequent updates or editing. Providing false, inaccurate, or outdated information is a violation of this Agreement and may result in the termination of your account and prohibition from using the site as a registered member. As the account user, it is your full responsibility to maintain the integrity of your account’s security, password, and all the actions that occur using your account.

2.2 Privacy. Epic Events cares about your privacy and is obligated to protect your personal information by making reasonable security arrangements against such risks as unauthorized access, use, collection, disclosure or disposal. Security measures have been integrated into the design, implementation and day-to-day operating practices as part of Epic Events commitment to protect the personal information it holds. For more details, please see our privacy policy. Use of this site implies your consent to the Buffalo Run privacy policy.

2.3 Termination. Epic Events reserves the right to terminate this Agreement at any time. Epic Events reserves the right to suspend and/or terminate your account indefinitely at any time for any actions or behaviors it deems unacceptable or for any violation of the terms and conditions of this Agreement. Epic Events reserves the right to deny users service at the company’s discretion and prohibit users whose accounts have been terminated from using the site as registered members.

2.4 Information and Content. Epic Events serves as a distributor of user-generated content and cannot be held responsible or liable for the accuracy of information posted or published on the site by third party users, companies, organizations, or sources. Epic Events reserves the right to edit or remove any content at its discretion without notification, particularly any content or information deemed to be inappropriate or in violation of the terms and conditions of this agreement. Epic Events cannot moderate, edit, or remove all inaccurate, inappropriate, or infringing content posted on the site, but will take a reasonable measures to edit or remove such content in a timely fashion. Epic Events has provided users with the ability to report inaccurate, inappropriate, and/or offensive content to Epic Events administration and requires your help in moderating these violations of the user Agreement. Epic Events does not tolerate the infringement of copyrighted content or material and takes the violation of proprietary rights very seriously (see Section 3 of this Agreement).

3. INTELLECTUAL PROPERTY

3.1 Proprietary Rights & Trademarks. The Buffalo Run site contains copyrighted materials, trademarks, trade name, logos, and various other intellectual properties owned and/or controlled by the company, which are protected by copyright laws and all related international treaties. The content and material contained within the Buffalo Run site is copyrighted as a collective work and is only available for your personal use and cannot be used for commercial purposes or financial gains of any sort. Use of any of these materials for other than their intended purpose (personal information and entertainment) on the site constitutes infringement and/or exploitation of Epic Events proprietary rights or the infringement of the rights of the contents’ contributor and will not be tolerated. You may not copy, download, store, modify, or reproduce any content or works within the Buffalo Run site without the express written consent of the Company and/or the owner of the rights in question. Any cases of infringement of proprietary rights must be reported to Epic Events administration immediately.

3.2. Third Party Web Sites and Content. The Buffalo Run site contains links, icons, and other hyper linked pointers that redirect users to the Internet Web sites of outside third parties, including sponsors and advertisers. Epic Events disclaims any and all responsibility and/or liability for the content posted, published, or distributed on outside third party Web sites. Epic Events also disclaims any and all responsibility and/or liability for the content posted, published, or distributed by outside third party users, companies, organizations, or sources. Epic Events does not control or endorse any of the content posted, published, or distributed by outside third parties on the Buffalo Run site or on outside third party Web sites. The views reflected in such content are not necessarily those of the company, any of its owners, directors, employees, affiliates, or subsidiaries.

3.3 Infringement Policy. Epic Events will not tolerate the infringement of copyrights or any proprietary rights on its site and deems this behavior, whether intentional or not, to be inappropriate, unacceptable, and a violation of the terms and conditions of this Agreement. Although Epic Events cannot control what content outside third party users, companies, organizations, or sources post or publish on the site, Epic Events will take reasonable action against users who infringe upon the rights of the company or the rights of others by:

3.3.1. Removing the infringing material or content from the site in a timely fashion.

3.3.2. Taking the necessary action against the infringing party, including:

  1. the suspension or termination of the user’s account
  2. prohibiting the user from posting or publishing content on the site
  3. prohibiting the user from registered membership with Epic Events.

Epic Events disclaims all responsibility and liability for the infringement of proprietary rights by its users. Infringement on the site should be reported to Epic Events administration immediately.

3.4 Copyright Complaints. Users must report the infringement of proprietary rights using the “Report Content” link or by contacting Epic Events.

 

4. SUBMISSIONS AND CONFIDENTIALITY

4.1 Submissions and Confidentiality. You acknowledge that any content or material submitted or transmitted through the Buffalo Run site is not confidential and may be viewed, read, or intercepted by other users. By sharing transmissions with other users you are waiving your right to a reasonable expectation of confidentiality and cannot hold other users liable for using the content contained within your transmission for their personal use. You also acknowledge and consent that any feedback, including questions, comments, ideas, suggestions or any other materials or information submitted by you to Epic Events are not confidential. These submissions or communications shall become the sole property of Epic Events,  granting the company exclusive rights to use them for any purpose whatsoever, whether commercially motivated or not, without acknowledgement or compensation to you.

5. USER CONDUCT

5.1 User Conduct. The terms regarding user conduct apply to all aspects of the Buffalo Run site, any content posted or published on the site, and also includes user interactions and content posted in the sites forums. User conduct is represented by the appropriateness of the content the user poses and the expectations on appropriate conduct are outlined below.

5.2 User Content Posted/Uploaded on the Site.

5.2.1. The following are restrictions on content that you agree not to upload:

  1. any content or behavior that is unlawful, libelous, defamatory, abusive, obscene, vulgar, indecent, offensive, pornographic, or sexually explicit.
  2. any content or behavior that is hateful or discriminatory towards the sex, gender, religion, creed, race, ethnicity, nationality, physical or mental disability, etc, of other users, or can be considered as harassment in any way.
  3. any content or behavior that is considered to instigate, advocate, or conspire to commit illegal activities, is considered to be a criminal act or offense, provoke civil liability, or is illegal in any way.
  4. any content or behavior that infringes or violates any of the protected or unprotected civil or proprietary rights of Epic Events, any user, or outside third party or parties, including content provided through the “Submit News” feature of the site.
  5. any content or behavior that contains a virus, spyware, or malware, or any other potentially harmful software.
  6. any content or behavior that is malicious or that prevents Epic Events, other users, or third parties from accessing and/or using the site.
  7. any content or behavior that includes false, misleading, or inaccurate information or representations, including any content provided through the “Submit News” feature of the site.
  8. any content or behavior that Epic Events, at its sole discretion, deems to be unsolicited promotion, offers, sales, advertising, attempts at commercialization, requests for money, personal information, petitions for signatures, or any such unsolicited advances or communication.
  9. any content or behavior that Epic Events, at its sole discretion, deems to be inappropriate, unacceptable, or against the purpose or nature of the site.
  10. You agree that you are eligible to post on this site and have complied with the age requirements set out in this Agreement.

Epic Events reserves the right to suspend or terminate user accounts that do not comply with terms and conditions of this agreement or violate the restrictions for content posting/uploading or user behavior on the Buffalo Run site. Epic Events maintains the sole discretion in determining the violation of this Agreement.

5.2 User Disputes. User disputes will be settled or resolved by the users involved in the dispute. Epic Events reserves the right to intervene in disputes between users but has no obligation to monitor or resolve any conflicts between users. Although we will do everything reasonably in our power to make sure that everyone can enjoy the site or service, Epic Events is not obligated in any way whatsoever to resolve disputes or grievances that occur with the Company as a result of accessing, use, or dissatisfaction with the site or any related services.

6. OTHER

6.1 Disclaimers. Epic Events is not responsible or liable in any way for your access or use of this site or your inability to access or use this site. The company is not responsible or liable for any resulting occurrences from your use or inability to use the services, content, or information available through the site. YOU WILL CHOOSE TO ACCESS AND USE THIS SITE AND ITS CONTENT, AS IS, AT YOUR OWN RISK. The company is not responsible, liable, or obligated to compensate you or any other users of the site for any reason and is not obligated to share any revenue, proceeds, or income that results from any of the company’s advertising or sponsorship efforts or any commercial activity or partnerships in which the company is involved in. The company cannot warrant that access to or use of the site or its services will be uninterrupted or free from error or failure. The company cannot warrant the accuracy, reliability, or quality of any content, information, or merchandise provided through the Buffalo Run site.

6.2 Liability. The company or site is not responsible or liable for any damages, injury, theft, destruction, unauthorized access or loss caused by or due to failure of performance, error, delay, interruption, or defect in the operation or transmission of the site, failure in communication, a computer virus or other technical problems. The company or site is not responsible or liable for infringement, defamation, offensive or illegal actions taken by other users or outside third parties and you agree that risk of damages or injury as a result of these actions are solely your responsibility.

6.3 Indemnity. You indemnify the company from any legal action or recourse and acknowledge and agree that the use of this site or related services is and was done so at your own risk. You consent that you are responsible and liable for any and all of the information and content from you post, list, upload on the site as well as any and all information you take, derive, receive, or use from the site or its other users and consent that you will not hold the company or site liable or responsible for any or all resulting consequences of such actions.

6.4 Jurisdiction.

This Agreement is governed by the laws of Great Britain without giving effect to any principles of conflict of law. You hereby consent to the exclusive jurisdiction of the High Court of Great Britain in respect of any disputes arising in connection with the website, or any relevant terms and conditions, policies and notices or any matter related to or in connection therewith.

 

CONCLUSION OF AGREEMENT

This concludes the entire site user Agreement between you and Epic Events. Use or accessing the site or its content or services implies your full consent to this Agreement and all of it’s terms and conditions. Any questions or concerns can be directed to the Company by contacting us.
